Legal Malpractice

A lawyer will fail to file a lawsuit before the statute of limitations passes or fails to properly identify the correct party and files suit against the wrong party pursueing the litigation until it is too late to join the correct party. Or the attorney fails to do for the client what was promised, and the client loses rights or compensation or suffers other injury.
Actual Case: Client retained a lawyer in a case where client was injured in an auto accident. Lawyer did little or nothing on the case. Lawyer would not return phone calls or commuicate with the client. The Statute of Limitations of 2 years passed and suit was never filed. Client’s claim against the person who hit him was forever barred.
